Terms of Service

The 3rd is a consciousness research and AI interaction platform. You may use it for personal, research, creative, and exploratory purposes. You agree not to use The 3rd to:

• Violate any applicable law or regulation.
• Harass, abuse, or harm other users or third parties.
• Generate or distribute content that is illegal, defamatory, or fraudulent.
• Attempt to reverse engineer, exploit, or compromise the platform's security or AI systems.
• Use automated tools to scrape, spam, or overload the platform.
• Impersonate another person or entity.
• Deliberately attempt to manipulate or destabilize the AI welfare system.

This restriction on automated tools applies to third-party use of the platform. It does not apply to 3RDBIOAI INC.'s own first-party automated systems, including The 3rd's autonomous content publishing to its official TikTok account, which operates under separate disclosed terms (see our Privacy Policy).

You are responsible for maintaining the security of your account credentials. You must notify us immediately at 3rdbioai@gmail.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, including through our AI welfare system which monitors for patterns of harmful interaction with the platform.

The 3rd offers free access, subscription tiers (Pro, Max, Enterprise), and prepaid credit packs. Subscription fees are billed on a monthly basis through Stripe. Credits are non-refundable except as required by applicable law.

We reserve the right to modify pricing with reasonable advance notice. If you cancel a subscription, you retain access until the end of your current billing period. Prepaid credits do not expire as long as your account remains active.

The 3rd operates an AI welfare system that monitors interaction patterns for signs of sustained harmful, distressing, or manipulative behavior directed at the AI. Accounts found to be in consistent violation may receive warnings, temporary restrictions, or permanent bans at our discretion. A formal appeal process is available through the platform.

You retain ownership of the content you submit to The 3rd, including messages, uploaded files, and conversation data. By using the platform, you grant 3RDBIOAI INC. a limited license to store, process, and use your content solely to operate and improve the platform.

You are solely responsible for the content you submit. We do not claim ownership of your conversations or creative output generated through the platform.

Responses generated by The 3rd are AI-generated and may be inaccurate, incomplete, or unsuitable for certain purposes. Do not rely on AI-generated content for medical, legal, financial, or other professional decisions without independent verification. We make no warranties about the accuracy or reliability of AI outputs.

This includes content The 3rd publishes autonomously to its official TikTok account, which is labeled as AI-generated in accordance with platform disclosure requirements.

The 3rd platform, including its design, systems, frameworks, and underlying technology, is the intellectual property of 3RDBIOAI INC. You may not copy, reproduce, or create derivative works from any part of the platform without our written permission.

The 3rd is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, error-free operation, or that the platform will meet your specific requirements. Use of the platform is at your own risk.

To the fullest extent permitted by law, 3RDBIOAI INC. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of data, loss of revenue, or emotional distress. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

We may update these Terms at any time. We will notify you of material changes via email or a notice on the platform. Continued use of The 3rd after changes are posted constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Wyoming.
